Note to Lewisham Council Executive Committee on Standing Orders



Please confirm the following summary points :-



1 - No Member of the Executive Committee has a pecuniary interest in the proposal for development of Pepys Estate, or with Hyde HA, contractors or sub-contractors; whatsoever. Nor any relatives of members.



2 - No Member of the Executive Committee has a non-pecuniary interest in the proposal for development of Pepys Estate, or with Hyde HA, contractors or sub-contractors; whatsoever. Nor any relatives of members.



3 - Decisions taken by Executive Committee must be taken in accordance with Standing Orders. Members must act in good faith and exercise reasonableness. No conclusion reached that no reasonable authority would.



4 - Decisions taken outside these principles are challengeable in Court by District Auditor.



5 - In the event of financial loss to the Council - councillors could be surcharged and /or disqualified.



6 - All senior Officers are under a legal responsibility, for example, Chief Executive, Executive Director of Resources, Head of Law, to make Members aware of their legal responsibility.



7 - Whilst Members may be strongly influenced by the view of others, particularly the political party to which they belong, they must make their own decision on what view to take of any matter before them.


Members personal interest ..... should not influence the decision.
Members must never do anything as a Councillor which they could not justify to the public.
..... avoid any occasion of suspicion or any appearance of improper conduct.



8 - All committee reports must include a 'financial implications' paragraph - revenue, capital, forward funding, budget virements, change of use of budget, etc.



9 - The Executive Committee has 11 members, Mayor, Deputy Mayor, 7 majority ( deputies ), 2 others.



10 - In an equality of votes, the Mayor has an additional casting vote.
